Terry's Health Products:

I am a business member, Terry's Health Products in Bismarck, ND and we have been battling for CBD oil since last year when our hemp CBD was confiscated by local police.  We have not gotten anywhere in the last 15 months so my attorney and I just submitted an official request to the ND Attorney General asking for an official opinion on the legal status of hemp derived CBD  in ND.  Stores across the state have continue to sell it but my business cannot and we do not think that is fair at all.  One thing great that has come out of this entire situation is that I have started a hemp seed foods company, Peace Garden Hemp.  We are retailing and wholesaling North Dakota Grown and Processed hemp seed oil, raw hemp hearts, and hemp protein powder.  Product launches in 2 weeks!!  We are so excited to grow this amazing product line of American grown ND hemp foods!!

CRM Pharmacies:

Clarification on Cannabidiol (CBD) Oil

The Board continues to receive questions about cannabidiol (CBD) oil (derived from hemp or derived from marijuana). The Ohio Revised Code includes CBD oil in the definition of marijuana, regardless of whether it is an isolated plant extract or synthetic product. HB 523, which created the state’s Medical Marijuana Control Program, made no exception for possession or sale of CBD oil.

Marijuana products, including CBD oil, can only be dispensed in a licensed Medical Marijuana Control Program dispensary. Those marijuana products will have to comply with the rules and regulations of the program. All products must have a known source, as well as known quantities of active ingredients. Testing procedures will be conducted by testing laboratories licensed by the Ohio Department of Commerce.

The State of Ohio Board of Pharmacy announced on June 4, 2018 the award of 56 provisional medical marijuana dispensary licensees. All provisional licensees will have six months to demonstrate compliance with the dispensary operational requirements to obtain a certificate of operation. As the Medical Marijuana Control Program becomes operational this fall, the Board will continue to provide updates through the program’s website:

Only those provisional dispensary licensees who receive a certificate of operation will be able to possess or sell marijuana, including CBD oil. No other persons or companies, including non-medical marijuana Board licensees such as pharmacies, may possess or sell CBD oil or other products meeting the definition of “marijuana.” Violations of Ohio Revised Code or Ohio Administrative Code can subject a licensee (person or entity) to administrative and/or criminal action.

Kentucky Hemp Producer Scales up Strategically

London, Kentucky:  39-year-old Brent Cornett is a 7-generation farmer, whose family farm includes beef, corn, soy, produce and, until recently, primarily tobacco, which is now being replaced with hemp.

“We watched Atalo Holdings’ Growers’ Group in Winchester help farmers add hemp to their rotation after the 2014 Farm Bill allowed it,” said Cornett. “We joined them to test 20 acres on our farm in 2016.  With the resources available from Atalo and the knowledge base of the Growers’ Group, we increased to 35 acres in 2017 and 85 acres this year.  There’s been plenty of challenges with a new crop, but as of today, a mediocre hemp crop is yielding a better return than an excellent tobacco crop,” he said.

Joseph Hickey and the other partners at Atalo Holdings have been advocating and innovating since 1993 to return hemp to the rotation.  They established Atalo in 2014 to help the Kentucky Hemp Pilot Program accelerate the state’s knowledge base through a Growers’ Group dedicated to research, development and commercialization.  According to Hickey, the process has been difficult but rewarding and Kentucky’s hemp industry is ready to scale dramatically, with fencerow to fencerow consistency. “What Atalo brings to the table is proprietary seed, dramatically improved agronomics including planting, harvesting, drying, quality controlled processing and access to markets,” said Hickey.  Atalo CEO, William Hilliard, sees the signs of growth.  “We started with 5 farmers and 35 acres in 2014. Today we have 60 farmers across Kentucky, plus farmers in Tennessee and North Carolina and more than 2,700 permitted acres.  We’re advising farmers in South Carolina, Pennsylvania, New York, West Virginia, Maryland and Wisconsin.  Our processing of CBD alone has grown 500% over last year. Our focus remains on research, development and commercialization and there are exciting times ahead.” he said.

These are positive signs for rural economic development.  Atalo estimates their Growers’ Group alone creates employment for over 600 farmers and laborers and 45 researchers, processors and administrators.

Brent Cornett is optimistic about hemp’s future.  “We have a good head start and hemp is becoming a bigger and bigger piece of the pie.  When hemp is legalized, we’ll be able to get insurance and also use the crop for collateral, then we can really take off,” he said.  “These are exciting times with the first new crop the rotation in 80 years.  It’s an excellent replacement for tobacco and we’re happy to be growing a crop that helps people instead of one that was found to hurt people.”
